Official Rules and Conditions
RULES AND CONDITIONS:
1. Entry. NO PURCHASE NECESSARY. A purchase will not enhance your ability to win. To enter via wireless registration, purchase one (1) of the following JAMDAT games: Downtown Texas Hold’Em, JAMDAT Casino Blackjack, or JAMDAT Hearts, by following the sweepstakes link on your Nextel phone between July 1, 2005 and August 31, 2005. All wireless entries must be received by 11:59 p.m. EDT on August 31, 2005. For no-purchase entry method via the Web, visit http://games.jamdat.com/nextelcontest. Web entries must be completed by August 31, 2005 to be eligible. Limit: One (1) entry per person, regardless of entry method. Sponsors (as defined by Section 7 of these Rules) do not assume any responsibility for (a) lost, incomplete, incorrect, or misdirected entries or (b) technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic or other communications. Sponsors, in their sole discretion, reserve the right to disqualify any person who tampers with the entry process, or who otherwise violates these rules. By entering, entrants agree that information provided upon entry may be shared with promotional partners, retailers, vendors and other companies without further notice or compensation and accept and agree to these Official Rules and Conditions. 2. Eligibility. Open only to residents of the 50 United States and Washington DC who are at least 18 years of age at time of entry. Employees of JAMDAT Mobile Inc., Nextel Communications, Inc. and their respective affiliates, subsidiaries, parents, representatives, advertising, promotion and publicity agencies and the immediate families of each are not eligible. Sweepstakes is void where prohibited, restricted or taxed by law. All federal, state and local laws and regulations apply. 3. Prizes. Total value of all prizes approximately $4,169 One (1) Grand Prize (ARV $2,748) - R/T airfare for two (2) to Las Vegas (ARV $1,200) - One (1) Hotel room for two (2) nights (ARV $650) - $500 spending money - Two (2) i850 Nextel camera phones (RV $199 ea./$398 total) One (1) Runner-up Prize (ARV $625) - One (1) i850 Nextel camera phone (RV $199) - 52" Kestell Folding Poker Table (ARV $296) - Texas Hold 'Em Poker Dealer Kit (ARV $130) Four (4) Bi-weekly Prizes (RV $796) - i850 Nextel camera phone Prizes are not transferable. No substitution for cash or other goods or services permitted, except Sponsors reserve the right to provide substitute prizes of comparable value. For Grand Prize package trip to Las Vegas, travel must be completed within one year of being awarded and blackout periods may apply. All expenses not specified above, including, without limitation, all federal, state and local taxes, and any travel or accommodations charges over and above those specified above, are the sole responsibility of the individual winners, and winners may be issued an IRS Form 1099 for the ARV of any awarded prize. 4. Winner Selection and Notification; Odds. Grand Prize, Runner Up and Weekly winners will be selected by random drawings, from among all eligible entries received by the deadlines set forth below:
*Random drawing on or about indicated date. Bi-weekly winners eligible for Runner-up and Grand Prize. Grand Prize winner not eligible for Runner-up Prize. Winners will be notified using contact information provided upon entry, and must complete and sign an affidavit of eligibility and, except where prohibited, liability/publicity release within 14 days of notification date to claim prize. If a winner cannot be contacted, does not respond as directed, refuses the prize or is determined ineligible, a new winner for that prize may be selected at the discretion of the Sponsors. In the event that a potential winner’s identity cannot be determined based on the eligible entry information, the prize will be awarded to the named account holder of the account from which the entry was submitted. Odds of winning depend upon the number of eligible entries received. 5. General Conditions. By participating, entrants agree (a) to abide by these Official Rules and the decisions of Sponsors, which will be binding and final in all respects; (b) to allow Sponsors to contact entrants for commercial purposes as allowed by law; (c) to indemnify, defend and hold harmless Sponsors and their respective affiliates, subsidiaries, parents, representatives, advertising, promotion and publicity agencies and the officers and employees of each of them (collectively, “the Companies”) from all liabilities, claims, law suits, costs, expenses, fees, injuries, (including death), losses, and damages resulting from participation in the sweepstakes, acceptance or use of any Prize, and/or from entrant’s fraudulent or wrongful acts or omissions; (d) not to sue Companies for any damages arising from winner’s acceptance of or use of any Prize; and (e) to allow Companies to use winner and guest name, voice, biography and likeness without further notice or compensation for promotion, advertising, filing and dissemination purposes, except where prohibited by law. Sponsors shall have the sole right to disqualify any contestant for violation of these rules or any applicable laws relating to the sweepstakes, and to resolve all disputes in their sole discretion. Companies (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty and (iii) are not liable for injuries, losses or damages arising out of any person’s participation in the sweepstakes or the acceptance and use of any prize, including travel relating thereto. All disputes will be resolved under applicable California law. Prizes are not transferable. Sponsors reserve the right to cancel or suspend the Sweepstakes for any reason. In the event of cancellation, Sponsors may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the sweepstakes up to the time and date of such cancellations. Sponsors are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable or destroyed entries resulting from any reason, including but not limited to: any hardware or software failures of any kind; lost or unavailable network connections; failed, incomplete or garbled computer or telephone transmissions; typographical or system errors; human errors, including but not limited to errors by Sponsors’ representatives who enter incorrect information into any of Sponsors’ computer systems; problems or technical malfunction of any telephone network or lines, computer online systems, servers, providers or computer equipment; or technical problems or traffic congestion on the Internet, at a website, or any combination thereof. The Companies are also not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing the sweepstakes, downloading any material for the sweepstakes or other telecommunications malfunctions which may limit an entrant's ability to participate. Sponsors may prohibit you from participating in the sweepstakes or winning a prize, if in their sole discretion they determine you are attempting to undermine the legitimate operation of the sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsors’ representatives. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE A WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. 6. Winners List. A winners’ list will be available at http://www.JAMDAT.com/nextelcontest/ and posted for approximately one month after all winners are determined. 7. Sponsors.
